FallLineIQ Terms of Use
These terms are an agreement between you and Viridis North LLC ("we") for the FallLineIQ apps and website (the "Service"). By creating an account or using the Service you accept them, and our Privacy Policy.
1. Who can use FallLineIQ
You must be at least 13 to have your own account. If you are 13 to 17, you need a parent's or guardian's permission. A child under 13 may use FallLineIQ only through an account owned by a parent or guardian, who accepts these terms for the child and is responsible for the child's use. Keep your sign-in to yourself; you are responsible for what happens under your account.
2. Skiing is dangerous; coaching is guidance
Skiing and ski racing carry a real risk of serious injury or death. FallLineIQ's coaching, measurements, race lines and AI answers are general guidance produced from video by software. They can be wrong, they do not see the snow, the terrain, your equipment or your health, and they are not a substitute for a qualified instructor or coach, or for medical advice. Ski within your ability, follow the slope's rules and your skier responsibility code, and stop any drill that feels unsafe. Never film while skiing in a way that distracts you or others. You use the Service at your own risk.
3. Free use and FallLineIQ Pro
Each account can have a limited number of coached runs a month for free (currently three). FallLineIQ Pro coaches every run and is offered as Pro Monthly ($19.99 a month) and the Season Pass ($99 a year), in US dollars; prices elsewhere are shown in the app. New subscribers may get a one-week free trial.
- In the iPhone or Android app, you buy through Apple or Google. The subscription renews automatically unless you cancel at least 24 hours before the end of the current period, and the renewal is charged within the 24 hours before the period ends. Manage or cancel it in your Apple Account settings or in Google Play → Payments & subscriptions. Refunds are handled by Apple or Google under their rules.
- On the website, you buy through Stripe. Manage or cancel in the app under Profile → Manage Subscription; cancellation takes effect at the end of the paid period.
- Deleting your account does not cancel an App Store or Google Play subscription; cancel it there first.
- We may change prices with notice; a change applies from your next renewal, and you can cancel before it.
4. Your content
You keep ownership of the videos, measurements, messages and other content you put into FallLineIQ. You give us a worldwide, non-exclusive, royalty-free license to host, process, copy and display that content only to provide the Service to you and to the coach or team you share it with, and for as long as it is in the Service. Only upload video you have the right to share. Do not film or upload other people without their permission, and never a minor without a parent's or guardian's permission.
5. Coaches and teams
A coach who invites athletes is responsible for having their consent (and, for minors, a parent's or guardian's consent) to film them and to use FallLineIQ with them, and for following their club's or federation's safeguarding rules. Messages in FallLineIQ must stay respectful and appropriate. We may remove content or accounts that break these terms.
6. Acceptable use
Do not misuse the Service: no unlawful, harassing, sexual, hateful or violent content; no attempts to reach other users' data, to break or overload the Service, or to bypass limits or payments; no copying, reverse engineering or scraping the Service except as the law allows; and no use of it to build a competing product.
7. AI features
Some coaching and the optional chat coach (adults only) use AI models from service providers. AI output can be inaccurate or incomplete; check it with common sense and a qualified coach before acting on it.
8. Changes and ending
We may change or stop features, and we will give reasonable notice of changes that matter to you. You can stop using the Service and delete your account at any time. We may suspend or end an account that breaks these terms or puts others at risk. Sections 2, 4 (for content already shared), 9, 10 and 11 survive.
9. Disclaimers
The Service is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement, and we do not promise that the Service will be uninterrupted, error-free or that its coaching will improve your skiing or keep you safe.
10. Limitation of liability
To the extent the law allows, Viridis North LLC is not liable for indirect, incidental, special, consequential or punitive damages, or for injury arising from skiing or from following coaching, and our total liability for any claim about the Service is limited to the greater of what you paid us in the 12 months before the claim and US$50. Some places do not allow these limits, so they may not apply to you.
11. Governing law
These terms are governed by the laws of the State of Vermont, USA, without regard to its conflict-of-law rules, and disputes go to the state or federal courts in Vermont, unless the law where you live gives you the right to bring a claim in your local courts.
12. If you got FallLineIQ from Apple's App Store
These terms are between you and Viridis North LLC only, not Apple, and Viridis North LLC, not Apple, is solely responsible for the app and its content. Your license to use the app is limited to Apple-branded devices you own or control, as the App Store's Usage Rules allow. Apple has no obligation to provide maintenance or support for the app. If the app fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the app's purchase price, if any; to the maximum extent the law allows, Apple has no other warranty obligation for the app. Viridis North LLC, not Apple, is responsible for addressing any claims relating to the app or your use of it, including product liability claims, claims that the app fails to meet a legal or regulatory requirement, and consumer protection or privacy claims, and for investigating, defending and settling any claim that the app infringes a third party's intellectual property. You represent that you are not in a country subject to a US Government embargo or designated as a "terrorist supporting" country, and that you are not on a US Government list of prohibited or restricted parties. You must comply with any third-party terms that apply when you use the app. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
